// TERMS OF SERVICE

References to ‘I’ and ‘Me’ refer to the artist (Computer Ram). References to ‘you’ refer to the client, who has purchased the commission service. By commissioning the artist you are agreeing to these terms of service. Clarification on any of these terms can be requested by clients before the commission is accepted and invoices are sent. If you have any concerns about the nature of the commission, it is recommended to contact me via email at computerram.art@gmail.com BEFORE sending your request.

Any severe violation of these terms of service by a client may render their commission status VOIDED and future services BLACKLISTED.

All artwork is digital. You will not receive a physical product.

I am allowed to decline any commission request, for any reason, even if it typically aligns with content I am comfortable with.

PAYMENTS

Payment via artist issued invoice must sent in full BEFORE the commission is started. Payment plans for illustration commissions can be discussed beforehand but are not guaranteed.

Commission prices are listed here with the assumption of PERSONAL USE only. If you intend to use my work for commercial use, I must be informed beforehand as this will likely incur higher fees.

Please note for Character Design services, the client will be expected to pay a non-refundable deposit up front in full. The remaining service charge will be sent via invoice once the design service is complete and the final artwork is produced. In the event of a large or complex character design order, payments can instead be scheduled on a per month basis. This is something that will be discussed before any invoices are sent.

REVISIONS

Clients will be typically allowed up to 5 free revisions on an artwork. Revisions in the thumbnailing stage do not count against this total. Major revisions to do with posing, composition, and subject matter late in development will incur a compensation fee even if the client still has free revisions ‘banked’ or ‘saved up’.

Clients ordering any service labled as 'Surprise Me!' (VGen Exclusive Service) will NOT receive progress updates on their commission, and will instead only be handed the final artwork with a watermark to correct mistakes, such as skin or eye colour. The client does not have the right to request revisions to pose or any other major compositional element.

DEADLINES AND DELIVERY

Progress shots that the client receives will have watermarks, to prevent theft. The final artwork file (full res PNG) the client receives will be free from watermarks. Refunds cannot be requested after the client has received the final artwork file free of watermarks.

Clients ordering any service labled as 'Surprise Me!' (VGen Exclusive Service) will still receive a watermarked file first before their final delivery. This is only to allow room for revisions (outlined above). The procedure follows the same as any other commission otherwise.

Expected turnaround times for commissioned work can vary between 2 weeks and 6 months, depending on the complexity of the order. If the client requires or expects their commission by a specific time, this must be explicitly stated. Please understand that I am currently in work and turnaround may be slower. A rush fee may be applied if the commissioned work is expected by a strict deadline.

USE - ARTIST

I am allowed the choice to post the commissioned artwork on social media, such as Twitter, Tumblr, Bluesky, and portfolio sites. This includes and progress/WIP uploads to social media and art progress streams on services like Twitch (twitch.tv/computerram). The client has the authority to restrict the hosting of their commissioned artwork on one/all of these sites, but this must be explicitly stated, and may incur an NDA fee.

The client has the choice to request their commissioned artwork be hosted by the artist with a watermark, but this must be explicitly stated.

I will explicitly ask the client’s permission before using their artwork to advertise future commission services. The client is free to decline.

Commissioned artwork will not be hosted in online sketchbooks nor be sold in any digital online marketplaces such as INPRNT (inprnt.com/profile/computerram) without explicit permission from the client.

USE - CLIENT

The client has the freedom to post their commissioned work online on social sites or personal websites. This includes cropping for icons or banners. However, credit must be listed explicitly. Clients that are caught listing my work without credit will be asked to either credit it or remove it. If the client continues to behave in this manner they will be blacklisted from future services.

Artwork that is commissioned for personal use should not be distributed and sold in any form by the client without prior discussion. Art that was initially commissioned for personal use may incur further fees post-completion if the client wishes to use it commercially in the future. Clients that break this term of service will be blacklisted from future services.

I do not consent to have any of my commissioned work used for AI Generation services. Clients that break this term of service will be blacklisted from future services.

TERMINATION OF SERVICE

I am allowed the choice to void a commission in progress in the event of constant revisions, lack of skill to complete the work, or unforeseen circumstances. Clients will be warned ahead of time when possible. The client will receive a refund (outlined below).

Due to the nature of the service, in the event a client requests to terminate a character design service that has had 12+ hours put into it the client may incur a cancellation fee relative to 50% of p/hour labour cost. The client's deposit will cover up to 50 GBP of this fee.

REFUNDS

Refunds will be up to 50% of initial invoice payment. Refunds will be sent no longer than 2 weeks after a client’s request for one. Please note the initial deposit for a character design service of 50 GBP is non-refundable.

COMMUNICATION

Communication will be done via the client's prefered communication platform. In the absence of a prefered platform, email will be the default. However, to deliver the final artwork (full res png), please be aware your email will be required regardless of prefered platform.

Clients ordering any service labled as 'Surprise Me!' (VGen Exclusive Service) will not recieve nor be expected to communicate throughout the duration of the commission. The only communication between client and artist will be during the lead up to final delivery.
